When you hire us to help you get a fresh start in bankruptcy, the first thing we will do is walk you through the “means test” to determine whether you are eligible for Chapter 7 bankruptcy or must file under Chapter 13. When the bankruptcy laws were changed in 2005, Congress introduced the means test as a way of limiting the number of Chapter 7 filings. Under this provision, you must demonstrate to the court that you lack the “means” to repay your creditors over a three-to-five-year period and need to permanently discharge some of your debts.
If you qualify for a Chapter 7 filing, you will be allowed to wipe out certain debts permanently in exchange for the sale of some of your property. Before you file a Chapter 7 petition, we will carefully explain what debts can be extinguished, as well as what property you can keep, so that there are no surprises and you get the relief you want. As a general rule, though, only unsecured debts, such as credit card or medical bills, can be discharged. You can use a Chapter 7 filing to suspend foreclosure or repossession efforts, but you cannot discharge secured debt and keep the property.
If you are not eligible to file under Chapter 7, or if you want to keep your property and make new payment arrangements, we can help you reorganize your debt under Chapter 13 bankruptcy. The most frequent use of a Chapter 13 filing is to stop foreclosure proceedings, but you can use Chapter 13 to restructure any debt, including unsecured obligations. When you file for protection under Chapter 13, you will need to prepare and submit a plan of reorganization to your creditors. We will help you put that plan together and will review any proposed repayment agreements to make certain they are within your means.
