If a person is injured in an accident he or she may have a legal claim for compensation (money award) for pain and suffering or losses such as medical expenses or any lost earnings. Here is some information to summarize the issue of "personal injury" if it happens to you or a family member:

  • If a person is injured as the result of an accident, the injured party should get immediate medical attention and a qualified attorney should be consulted.
  • During our first consultation we will ask how the accident happened, what the extent of your injuries are, if you've ever been injured before and other personal data.
  • If you retain Limmer & Associates we will contact all involved parties such as the insurance companies and other parties to the accident, DMV, and any one else we feel is important to your case.
  • We will not seek to settle your case until your medical treatment is completed, because we must know what the full extent of your injuries are before we seek a fair settlement.
  • If we cannot agree with the insurance company on a "fair settlement" we will begin a lawsuit by filing a "Summons and Complaint" and serving it upon the "at fault" party. They will then respond with an answer and we will provide each other with "discovery" (exploration of the situation). Depositions (an explanation of what happened) will then be taken from all involved parties.
  • When all "discovery" is finished, we ask the court to put the case on the trial calendar. Upon receiving a court date we will pick a jury and try the case to conclusion.

Be aware that from the initial contact with the insurance company to any point up till the jury verdict, we are always conducting settlement negotiations in the attempt to secure you a fair recovery.
