If your child has special needs and is being denied his or her educational rights, we can help you. As your attorneys we can provide the following:
- Phone consultation: During our initial phone consultation we will discuss the issues facing your child and outline a plan of action. We will set up an appointment for you to come into the office where we can further discuss the specifics of representation and goals for your child.
- Evaluation and determination of a course of action: Before we meet with you, we review your child’s evaluations, IEPs (individualized education plans,) and any other records that you provide to us. When we first meet we will go over all issues regarding your child, what services are available for your child, the best plan of action to get these services from the school and we will explain how the overall process works. We may request that you take your child for a private evaluation to assist in the process of identifying appropriate services for your child.
- Representation at School meetings: We will most likely request an IEP meeting to discuss resolution of the issues in your case with the school district. Usually the district’s attorney will also attend. Resolution of your concerns will be our focus. The goal is to secure your objectives, not litigate. We will do everything we can to negotiate and agree upon an IEP with your child’s school.
- Negotiation and monitoring of services: We will work with the school to make sure your child is receiving the services that are required and will monitor to make sure the agreed upon services are implemented and maintained.
- Bring a “due process” action: Sometimes, despite your best efforts, you cannot get the services your child needs at school through informal means. The school district may simply believe that your child is not legally entitled to the services you seek. Or there may be other reasons that an informal agreement cannot be worked out. In such cases, we can go over with you the potential risks, benefits, costs and other factors that you need to consider in determining whether to bring a lawsuit against the school district. If you decide to sue, and if we believe that you have a meritorious case, we will represent you every step of the way.
