What is stalking?
A person is guilty of stalking when he or she intentionally, and for no legitimate purpose:
- Causes reasonable fear of material harm to the physical health, safety or property of a person, a member of that person's immediate family or a third party with whom that person is acquainted; or
- Causes material harm to the mental or emotional health of a person, through communication via the phone, the targeted person's immediate family, or a third party with whom the targeted person is acquainted
- Causes the targeted person reasonable fear that his or her employment, business or career is threatened.
Stalking victims are usually:

There are various degrees of stalking. Classification is dependent upon several factors including:
- If the defendant is a repeat convicted offender
- If the defendant had been warned before
- How many people the person is accused of stalking
- If the accused person threatened death, kidnapping or a sexual offense
- If a weapon – or the appearance of a weapon - was used
- The age of the victim
- The age of the arrested
- If the stalking victim was physically injured due to an intentional or reckless act
First Degree and Second Degree stalking are felonies. Lesser degrees are classified as misdemeanors. Also, depending on the case, stalking may involve concurrent charges such as breaking and entering, trespassing or intimidation of a witness.
